Canons of the Code 1983
All the canons that are found in the in iure and in the in facto part of the decisions are reported in the sources.

Legal Summary
1. Haud remittunt in terminos, ad recursum contentiosum administrativum proponendum quod attinet, litterae Superioris hierarchici quae de recursus hierarchici obiecto sileant (in casu, recursu hierarchico adversus denegatam excardinationem interposito, competens Curiae Romanae Dicasterium generica invitatione in dioecesim regrediendi litteras foras dedit).
1. Non rimette in termini, relativamente alla proposizione del ricorso contenzioso amministrativo, la lettera del Superiore gerarchico la quale ometta di trattare dell’oggetto del ricorso gerarchico (nel caso, interposto ricorso gerarchico contro la negata escardinazione, il competente Dicastero della Curia Romana inviava una lettera generica di invito a tornare in diocesi.
2. Ignorantia legis (cf. can. 15, § 2) haud admittitur (cf. can. 201, § 2), si recurrens studiis iuris canonici diu incubuit (in casu, per sex annos).
2. L’ignoranza della legge (cf. can. 15, § 2) non si ammette (cf. can. 201, § 2), se il ricorrente ha studiato a lungo il diritto canonico (nel caso, sei anni).
3. Extrema penuria cleri haud est causa arbitraria denegatae excardinationis, sed gravis (cf. can. 270).
3. L’estrema povertà di clero non è motivo arbitrario per negare l’escardinazione, ma costituisce causa grave (cf. can. 270).
