Haud remittunt in terminos, ad recursum contentiosum administrativum proponendum quod attinet, litterae Superioris hierarchici quae de recursus hierarchici obiecto sileant (in casu, recursu hierarchico adversus poenam suspensionis interposito, competens Curiae Romanae Dicasterium mera exhortatione Ordinario parendi litteras foras dedit).1. Non rimette in termini, relativamente alla proposizione del ricorso contenzioso amministrativo, la lettera del Superiore gerarchico la quale ometta di trattare dell’oggetto del ricorso gerarchico (nel caso, interposto ricorso gerarchico contro la pena della sospensione, il competente Dicastero della Curia Romana inviava una lettera con la mera esortazione ad obbedire all’Ordinario).
