Tamquam documenta postea detecta, de quibus in can. 1645, § 2, n. 2, haberi nequeunt documenta postea confecta vel documenta quae iam habebantur in actis causae et ab advocatis partium inspici poterant (in casu, iamvero, litterarum de quibus alterae iam diu exstabant in actis causae principalis, alterae non sunt postea detectae sed confectae).1. Non possono considerarsi come documenti scoperti dopo, di cui al can. 1645, § 2, n. 2, documenti confezionati dopo o documenti che già erano presenti negli atti e potevano essere esaminati dagli avvocati delle parti (nel caso, però, delle lettere in oggetto, una era presente da lungo tempo negli atti della causa principale, l’altra non è stata scoperta, ma confezionata dopo).
