Legal Summary
1. Legitime propositus habendus est recursus hierarchicus quo recurrentes intra terminum praestitutum ad competens Curiae Romanae Dicasterium responsionem transmittant Vicarii episcopalis qua notificaverit Episcopum decisionem confirmavisse et amplam explanationem quoad rationes motivas dederit, recursu hierarchico praepropere proposito confirmato.
1. Si deve considerare legittimamente proposto il ricorso gerarchico con il quale entro il termine stabilito i ricorrenti trasmettano al competente Dicastero della Curia Romana la risposta del Vicario episcopale con la quale egli abbia notificato la conferma del Vescovo e abbia dato ampia spiegazione delle ragioni motive, confermato il ricorso gerarchico in anticipo presentato.
2. Decretum motivis instructum habendum est si Vicarius episcopalis rationes motivas alibi datas in responsione ad remonstrationem amplius exponit.
2. Si deve ritenere provvisto dei motivi il decreto se il Vicario episcopale nella risposta alla rimostranza espone ampiamente i motivi altrove dati.
3. Lex Ecclesiae ad paroeciae suppressionem postulat ut rationes motivae sint iustae, non autem graves. Quarum existimatio praecipue et necessarie discrimini Episcopi committitur, adeo ut cum haud probetur eum arbitrarie egisse, eius decisio a competenti Curiae Romanae Dicasterio confirmata sustinetur.
3. La legge della Chiesa sulla soppressione della parrocchia richiede che le ragioni siano giuste, non però gravi. La loro valutazione è rimessa principalmente e necessariamente al giudizio del Vescovo così che se non si provi che egli ha agito arbitrariamente, la sua decisione confermata dal competente Dicastero della Curia Romana si sostiene.
4. Iurisprudentia aequiparat clausuram ecclesiae cum eius reductione in usum profanum (in casu iam proposita erat ecclesiae alienatio).
4. La giurisprudenza equipara la chiusura della chiesa alla sua riduzione ad uso profano (nel caso già ne era proposta la vendita).
5. Ad causas graves de quibus in can. 1222, § 2 constituendas sufficere nequeunt rationes motivae characteris generalis uti v.gr. reductio numeri sacerdotum, numerus elevatus aedificiorum sacrorum, generalis reordinatio structurae pastoralis. Necessarium est in singulis casibus probare reapse haberi causas graves (in casu ex actis constat de optimo statu conservationis ecclesiae, dum fideles parati sunt ad necessarios sumptus pro ecclesia sustinendos).
5. Per le cause gravi di cui al can. 1222, § 2 non bastano ragioni motive di carattere generale, come, per esempio, la riduzione del numero di sacerdoti, l’elevato numero di edifici sacri o il riordinamento generale della struttura pastorale. È necessario provare nei singoli casi che realmente si danno cause gravi (nel caso consta dagli atti dell’ottimo stato di conservazione della chiesa e che i fedeli sono pronti a sostenere le spese necessarie per la chiesa).
