Legal Summary

1. Parochus translatus, pendente recursu, debet a parochi munere exercendo abstinere, quam primum liberam relinquere paroecialem domum, et omnia quae ad paroeciam pertinent administratori paroeciali ab Episcopo nominato tradere.
2. Adversus parochum, praescriptis can. 1752 cum can. 1747, §§ 1 et 3 colligati haud parentem, per decretum poenale delicta, de quibus in cann. 1371, n. 2, 1373 et 1381, § 2, adduci possunt.
3. Recursus, adversus poenam impositam, eiusdem poenae suspensionem perdurante recursu secumfert, minime vero suspensionem obligationum, ob quarum neglectum poena imposita est.

1. Nella pendenza del ricorso il parroco trasferito deve astenersi dall’esercizio dell’ufficio di parroco, lasciare libera quanto prima la casa canonica, e consegnare all’amministratore parrocchiale nominato dal vescovo tutto quanto appartiene alla parrocchia.
2. Contro il parroco che non obbedisce ai prescritti del can. 1752 collegato con il can. 1747, §§ 1 e 3, possono essere addotti con decreto penale i delitti, di cui nei cann. 1371, n. 2, 1373 et 1381, § 2.
3. Il ricorso contro la pena imposta comporta, durante il ricorso, la sospensione della stessa pena, non però la sospensione degli obblighi per la cui disobbedienza la pena è stata imposta.
