Canons of the Code 1983
All the canons that are found in the in iure and in the in facto part of the decisions are reported in the sources.

Legal Summary
1. Habetur vitium subreptionis (cf. can. 63, § 1) in precibus quoties auctoritas competens per subreptionem in errorem inducta est et quidem in errorem qui recidit in condicionem sine qua non (in casu candidatus modo æquivoco suam condicionem exposuit tempore quo Congregatio vigilantior facta erat ad indebitum cumulum munerum vitandum, et iam præparavit declarationem ad rem. Id evincitur etiam ex modo agendi Congregationis, quæ, statim ac edocta facta est de duplici munere intervenit).1. Si ha nella domanda vizio di surrezione (cf. can. 63, § 1) ogniqualvolta l’autorità competente dalla surrezione è indotta in errore e in un errore che ricade in una condizione sine qua non (nel caso il candidato espose la sua condizione in modo equivoco quando già la Congregazione si era fatti alquanto vigilante per evitare un indebito cumulo di uffici e già preparava una dichiarazione al riguardo. Ciò si evince anche dalla reazione della Congregazione che è intervenuta non appena accortasi del duplice incarico).
