CIC cann. 50; 308; 316 § 2
Legal Summary
1. Dimissio sodalis a consociatione, praeterquam praescripto can. 316, § 2 pro casibus in § 1 eiusdem canonis recensitis, statutis uniuscuiusque consociationis regitur (cf. can. 308).
1. The dismissal of a member from the association is governed not only by the prescriptions of can. 316, § 2 for the cases reviewed in § 1 of the same canon, but also by the statutes of each association (cf. can. 308).
2. Procedura de qua in can. 308 non necessario remittit ad can. 316, § 2, quippe qui pro casibus in § 1 recensitis valet, sed ad can. 50 praescriptum, quod auditionem quorum iura laedi possunt, tantum «quantum fieri potest» praevidet.
2. The procedure provided for in can. 308 does not necessarily refer to can. 316, § 2, which applies to the cases provided for in § 1, but to the prescriptions of can. 50, which provides for the hearing only "insofar as this is possible" of those whose rights can be injured.
3. In qua clausula can. 50 ponderanda, cavendum est in casu dimissionem haud perfectam esse nisi post decisionem Ordinarii loci, per recursum in statutis praevisum aditi.
3. In evaluating this clause of can. 50, care must be taken that in each case the dismissal is not effected until after the decision of the Ordinary of the place, to whom recourse can be made as provided for in the statutes.
4. Cum agatur de actu praevio, Commissionis audiendae munus ad modum decisionis ponderandum non est.
4. Since it is a preliminary act, the duty to hear a committee should not be evaluated as if it were a decision.
5. Dimissionis causa in statutis praevisa (in casu, carentia «di buona condotta morale»), non autem iuxta principia prima dimetienda est, sed habita ratione sive naturae consociationis (in casu, paroecialis), in qua in primis spiritus communionis intra ambitum eiusdem paroeciae officium praecipuum sodalium constituit, sive aliarum condicionum pro quibus iuxta consociationis statuta dimissio fieri potest.
5. A reason for dismissal provided for in the statutes (in this case, the lack of "morally good conduct"), should not be measured according to the first principles, but having regard both to the nature of the association (in this case, parochial), in which above all the spirit of communion within the parish itself constitutes the principal duty of the members, and to the other reasons in virtue of which according to the statutes one can be dismissed.
