Legal Summary
1. Etsi Concilium Vaticanum II modum procedendi in amotione parochorum propter rationes pastorales faciliorem expeditioremque reddat, nihilominus dici non potest ad coactam translationem sufficere quamcumque causam ordinis pastoralis, nempe ad arbitrium Episcopi, eo quod in motu proprio Ecclesiae Sanctae statuitur, ad validam translationem parochi renuentis, normas Codicis, usque ad codicem recognitum, servandas esse.1. Although the Second Vatican Council, for pastoral reasons, renders the procedure for the removal of pastors easier and more expeditious, it nonetheless cannot be said that any reason whatsoever of the pastoral order — namely, one left to the Bishop’s free will — suffices for a compulsory transfer; inasmuch as the motu proprio Ecclesiae Sanctae lays down that, for the valid transfer of a pastor who refuses it, the norms of the Code are to be observed until the revised Code [is promulgated].
