Ecclesiae Sanctae I, n. 20 § 1
Legal Summary
1. Parochus renuntiare sub condicione non potest, quia Litterae Apostolicae motu proprio datae Ecclesiae Sanctae (n. 20, § 1) can. 2150, § 3 abrogaverunt.
1. A pastor cannot renounce his office under a condition, because the Apostolic Letter issued motu proprio Ecclesiae Sanctae (n. 20, § 1) abrogated can. 2150, § 3. For this reason, a pact or contract on this matter between the Ordinary and the renouncing pastor is excluded by the prescript of the law.
2. The local Ordinary cannot oblige the diocese or a diocesan institute to pay a renouncing pastor, until death, a fixed pension that is disbursed only to priests discharged from every office, even if the one renouncing has from other sources the means necessary for fitting support.
3. By the term "law" is understood not only a prescript of the Code, but also covenants entered into or contracts — which the Apostolic Signatura too admits (in this case, reference is made to the decree of 6 April 1920, in AAS 12 [1920] 257).
