Legal Summary
1. In the contentious-administrative process before the Apostolic Signatura, the resisting party, in the present case, is not the Dicastery of the Roman Curia that rendered the contested decision, but the Ordinary or Superior who placed the administrative act from which the controversy arose.
2. The one making recourse and the other party may stand in this trial "only through a Patron" (Normae Speciales, art. 99, § 1). If either party, for whatever reason, has not constituted a Patron for itself, "the Secretary himself proceeds ex officio to the appointment" (Normae Speciales, art. 99, § 3). All the circumstances having been considered, the person deemed more suitable to defend the case is appointed as Patron, and his name is communicated to the party.
