Legal Summary
Cf. maximae prot. n. 574/69 CA.
1. Capitular Statutes that have been duly approved, since they are not contrary to the ius commune and have not been legitimately changed, cannot be said to be abrogated (in the case at hand the Statutes adopted the system of the common capitular fund, for the application of which account must be taken of the Decree issued by the Sacred Congregation of the Council on 10 July 1925).
2. Since the principal question at issue turns on the manner of distribution in the Chapter, and since it is a question of the Chapter rather than of the individual canons — even if the manner of distribution divides the Chapter into two opposing sides — it is expedient that the expenses of the case and the honoraria of the Patrons be paid, for the sake of justice and equity as well as for the love of peace, from the common fund of the Chapter. For the question to be resolved belongs to the Chapter.
